In this case, the petitioner is seeking bail in connection with Ariyari P.S. Case No. 116 of 2015 registered for offences under sections 364, 302, 201, 34 of the Indian Penal Code.

An allegation has been made against the petitioner that the younger brother of the Informant went to visit Dashhara fair at Sheikhpura on motorcycle but he did not return. During investigation, Sanjay Mandal, Guddu Kumar and Niranjan were arrested and on their statement, the body of the victim was recovered the body of the victim was recovered. The blood stained Hasuli was also recovered and so much so that mobile of the

Patna High Court Cr.Misc. No.18392 of 2016 (2) dt.03-05-2016 victim was also recovered from the house of the petitioner. It has also been stated that the trial has also started and two witnesses have also been examined.

Looking to the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner, namely, Niranjan Kumar is rejected.

The trial court is directed to conclude the trial within a period of one year from the date of receipt of this order. (Shivaji Pandey, J) Rishi/- U T
