The petitioner is languishing in custody since 26.03.2015 in a case registered for the offences punishable under sections 147/148/341/323/332/337/338/307/353/427/435/325 of the Indian Penal Code.

The prosecution case is that a truck collided with a motorcycle resulted into death of eight persons and injuries being caused to several persons. Consequently, a mob of 400-500 people made protest after pelting stones, put the alleged truck on fire when police went to pacify the mob, the mob pelted stones on the police personal also and damaged other vehicles. The names of the petitioner and others were suggested by the local Chaukidar on subsequent enquiry and for the same occurrence

Patna High Court Cr.Misc. No.25738 of 2015 (2) dt.23-07-2015 2/2 three cases i.e. Buxar (T0 P.S. Case No. 117 of 2015, Buxar (T) P.S. Case No. 118 of 2015 and Buxar Industrial P.S. Case No. 32 of 2015 were registered by the police.

It is submitted by learned counsel for the petitioner that accusation is against the mob and only on suspicion the petitioner has been roped in all the three cases by the police personnel in order to save their own skin.

Considering the accusation against the mob, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Buxar (T) P.S. Case No.117 of 2015.
