This appeal has been preferred in accordance with Section 101 of the Juvenile Justice Act against the order dated 24.01.2018 passed by learned First Addl. Sessions Judge, Patna refusing the appellant to be released on bail relating to Special (Child) Case No.7/2018 arising out of Pribahore P.S. Case No.603/2017.
There happens to be an allegation against the appellant that he along with Abhishek Anand have tried to conceal the smack packet beneath their leg. In absence of criminal antecedent as incorporated under para-3 of the memo of appeal in consonance with the nature of the allegation, appellant Gautam Kumar is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of First Additional Sessions Judge, Patna in connection with Spl. (Child) Case No.7/2018 arising out of Pirbahore P.S. Case no.603/2017, subject to condition that one of the bailor should be his father who will give an undertaking that henceforth he will keep proper vigil
Patna High Court CR. APP (SJ) No.731 of 2018 (5) dt.16-04-2018 over the activity of the delinquent till pendency of instant case. In terms thereof, appeal is allowed.
