The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 341, 323, 498A, 326, 302/34 of the Indian Penal Code. As per prosecution case, it is a case of dowry death due to non-fulfillment of dowry demand and the petitioner is alleged to be father-in-law of the deceased. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is father-in-law of the deceased due to which he has falsely been implicated in the present case. The petitioner has no concern mess and business of the deceased

Patna High Court CR. MISC. No.51891 of 2023(2) dt.25-08-2023 2/2 as well as her husband and was living separately from them. There is no specific allegation against the petitioner and there is no eye-witness of the alleged occurrence. It is further submitted that the petitioner is languishing in judicial custody since 27.03.2023.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Runnisaidpur P.S. Case No. 169 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Pupri at Sitamarhi.
