JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-07-2015 Petitioner is languishing in custody since in a case registered for the offences punishable under Sections 147, 148, 149, 150, 114, 186, 353, 332, 333, 427, 436, 341, 323, 380, 302 of the Indian Penal Code.
The prosecution case is that a truck collided with a motorcycle resulting into injuries to several persons. Consequently a mob of 400-500 people made protest by pelting stones and put the alleged truck on fire. When the police went to pacify the mob, the mob pelted stones on the police personnel also. The name of the petitioner was suggested by the local Chaukidar on subsequent enquiry and for the same occurrence three cases being Buxar(T) P.S. Case No. 117 of 2015, Buxar(T) P.S. Case No. 118 of 2015 and the present case were registered by the police. The petitioner has prayed for bail in the present case being Buxar (Industrial Area) P.S. Case No.
Patna High Court Cr.Misc. No.26145 of 2015 (2) dt.24-07-2015 2/2 32 of 2015, though petitioner is accused in other two cases also.
It is submitted by learned counsel for the petitioner that accusation is against the mob and only on suspicion the petitioner has been roped in all the three cases by police just in order to save their own skin. Considering the accusation against the mob, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Buxar(Industrial) P.S. Case No. 32 of 2015.
