JUSTICE SHIVAJI PANDEY ORAL ORDER 26-04-2016 Heard learned counsel for the petitioner and the learned counsel for the State as also learned counsel for the Bank. In this case the petitioner seeks bail in Bahera P.S.Case No. 508/2015 instituted for the offences under sections 382, 384, 387 of the Indian Penal Code.
As per the allegation the petitioner entered into the bank with a sharp cutting weapon and demanded money from the cashier. By that time the casher raised alarm. He was arrested at the spot. No untoward accident took place.
Learned counsel for the petitioner submits that he is a bonafide customer and he has applied for the loan but there was some dispute with the Bank Manager as Bank Manager was demanding money which he refused and that in turn allegation has
Patna High Court Cr.Misc. No.17194 of 2016 (2) dt.26-04-2016 been made of using Aari for threatening the life. Looking to the entire facts and circumstances of the case, let the petitioner, Sogarath Paswsan @ Sugarath Paswan, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri A.P.Choudhary, Judicial Magistrate, 1st Class, Benipur, District Darbhanga in Bahera P.S.Case No. 508/2015, corresponding to G.R.No. 507/2015.
