The petitioner seeks bail in a case registered for the offence under Section 307 & other allied sections of the Indian Penal Code and Sections 25(1-B)A, 26, 27, 35 of the Arms Act. Petitioner is not named in the FIR. Name of the petitioner has transpired during course of investigation in the confessional statement of co-accused Subair Alam. Neither any arms or ammunition has been recovered from the possession of this petitioner nor he was arrested on spot. Some of the similarly situated co-accused persons have already been granted bail by this Court, vide orders annexed at Annexure 2 to the petition and petitioner is in custody since 23.11.2020.

Learned A.P.P. for the State has opposed the bail petition.

Patna High Court CR. MISC. No.59056 of 2021(3) dt.31-03-2022 2/2 Considering the aforesaid facts and circumstances as well as period of custody, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Session Judge Vth, Khagaria in connection with Sessions Case No. 261(A) of 2010, arising out of Beldaur P.S. Case No. 59 of 2001.
