JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered initially, under Section-394 of the Indian Penal Code, in which, later on, Section412 was also added. Petitioner is neither named in the first information report nor anything has been recovered from his conscious possession.
It appears from perusal of the impugned order that in course of investigation, two witnesses claimed to have seen the petitioner and two others along with a motorcycle. Except the aforesaid material as well as criminal antecedent of the petitioner, there appears to be nothing against the petitioner.

No.18161 of 2016 (2) dt.03-05-2016 2/2 Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Adapur P.S. Case No. 14 of 2015 to the satisfaction of learned Sub Divisional Judicial Magistrate, Raxaul, Motihari, East Champaran.
