The petitioner is in custody in a case registered under Section 398 of the Indian Penal Code.
The prosecution case, in brief, is that while the informant-ASI, Ahiyapur Police Station along with his other police associates were on mobile duty, they got secret information that some miscreants have assembled to commit robbery near Sangam Bridge on N.H.-57 and when the police team reached there, 7 to 8 miscreants made good their escape but the petitioner was apprehended on the spot. Hence, this F.I.R.
On behalf of the petitioner, it is submitted that the
Patna High Court Cr.Misc. No.26128 of 2015 (2) dt.27-07-2015 2/2 petitioner is in custody since 10.3.2015 and charge sheet has been submitted in the case. The petitioner has no criminal antecedents. It is further submitted that the petitioner is a Labourer and has been implicated in the present case due to mistake of fact.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur, in connection with Ahiyapur P.S. Case No.201 of 2015.
