JUSTICE SUDHIR SINGH ORAL ORDER 26-05-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 363, 365, 367 and 371 of the Indian Penal Code. Allegation against the petitioner is that he along with other accused persons has abducted brother of the informant. It has been submitted on behalf of the petitioner that he is in custody since 11.8.2015. He has got no criminal antecedent. Chargesheet has been submitted in the case. There is no allegation of tampering of evidence against the petitioner. Petitioner has been made accused due to mistake of fact. The victim boy has already been recovered and parties have entered into a compromise vide Annexure- 3 to the present application. On behalf of the State, it is submitted that petitioner is named in the F.I.R.

No.19213 of 2016 (3) dt.26-05-2016 2/2 Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, Hilsa, Nalanda, in connection with Islampur P.S. Case no. 231 of 2015.
