The petitioners apprehend their arrest in Barun P.S. Case No.189 of 2017 registered under Sections 379, 411, 420, 120(B), 34 of the Indian Penal Code and 3, 4, 5 of Bihar Mineral Act and Section 75, 80 of the Bihar Minar Minerals Act. The learned counsel for the petitioner submits that the police intercepted the tractor loaded with sand. Petitioner No.1 and 3 are the owner of the tractor and petitioner No.2 and 4 are drivers of both the tractors. Sands were being carried on valid papers. The petitioner has taken papers from the Mines and Mineral Department. It is annexed as Annexure '2 series.

No.63687 of 2017 (2) dt.11-01-2018 Considering the facts aforesaid and the nature of allegation made against the petitioners, the petitioners, above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks from the date of receipt / production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Aurangabad in connection with Barun P.S. Case No.189 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
