The petitioners seek pre-arrest bail in connection with Gandhi Maidan P.S. Case No.292 of 2017 registered under Sections 452, 383 and 427/34 of the Indian Penal Code. It is submitted by the learned counsel for the petitioners that the petitioners have no concern with the disputed property. He submitted that the petitioners are neighbour of co-accused Annapurna Devi and as they had intervened into the matter when the dispute had taken place between the informant and the Annapurna Devi, they have also been named in the FIR, but subsequently at the intervention of common friends and well
Patna High Court Cr.Misc. No.542 of 2018 (2) dt.11-01-2018 2/2 wishers, the dispute has been resolved between the parties and the informant has also filed a compromise petition in this regard. Learned counsel for the State has opposed the prayer for grant of pre-arrest bail to the petitioners.
Considering the nature of allegation and the submissions made above, in the event of arrest or surrender in the court below within six weeks from today, the petitioners are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Judge-VI-cum-Additional Chief Judicial Magistrate, Patna in connection with Gandhi Maidan P.S. Case No.292 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Ashwani Kumar Singh, J) Md.S./- U T
