The petitioner seeks bail in a case registered for the offence punishable under Sections 341, 323, 307, 379 and 504/34 of the Indian Penal Code.
The allegation is that the accused persons including the petitioner came to the house of the informant, caught hold of him and assaulted him with hard and blunt substance. The informant received head injury and fell down. The petitioner took out Rs.2200/- from his pocket.
Learned counsel for the petitioner submits that there is no specific allegation of assault against the petitioner. He has been falsely implicated in this case. The petitioner has no criminal antecedent.
Considering the facts and circumstances of
Patna High Court Cr.Misc. No.12821 of 2015 (2) dt.02-06-2015 2 / 2 this case, the above-named petitioner is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri P. K. Jha, Judicial Magistrate, Ist Class, Gaya in Fatehpur P.S. Case No. 303 of 2014 with the following conditions :
1. One of the bailors will be the close relative of the petitioner.
2. The petitioner will not indulge in similar or in any other offence.
3. The petitioner will be well represented in the court.
4. In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the court concerned.
