The petitioners apprehend their arrest in Rajeev Nagar P.S. Case No.143 of 2016 registered under Sections 420, 406, 467, 468, 471 of I.P.A. and Section 3 of the Prevention of Damage to Public Properly Act.
The learned counsel for the petitioner submits that the Executive Engineer, Housing Board, Patna lodged a case against the petitioner making allegation that they had illegally constructed their house on the plots. The learned counsel for the petitioner further submits that petitioners purchased the land and constructed their house in 2008. The informant lodged the false case and no offence under any Sections of the IPC is made out. Considering the facts aforesaid and the nature of allegation
Patna High Court Cr.Misc. No.63753 of 2017 (2) dt.12-01-2018 2/2 made against the petitioners, the petitioners, above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks from the date of receipt / production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Patna in connection with Rajeev Nagar P.S. Case No.143 of 2016, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
