Mr. Sri Manoj Kumar - 1 ====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 10-04-2018 Heard learned counsel for the petitioner and the State. This is an application for regular bail in connection with Sitamarhi P. S. Case No. 735 of 2017 registered for the offences punishable under Sections 302/34 of the Indian Penal Code.
Informant in his FIR has alleged that at about 8-40 P.M. while his father was returning home with money after closing his shop, some unknown miscreants assaulted him with knife and in course of treatment he died.
It has been submitted on behalf of petitioner that he is innocent and has falsely been implicated in this case. Petitioner is neither named in FIR nor any incriminating article has been recovered from his possession. He has not been put on TIP. Name of petitioner has surfaced in this case on the basis of
Patna High Court Cr.Misc. No.14894 of 2018(3) dt.10-04-2018 2/2 confessional statement of co-accused. He has got no criminal antecedent and is in custody since 20.9.2017. It has further been submitted that similarly situated co-accused persons Mangal Kumar and Ravi Kumar have been granted bail vide Annexure-2 to this petition.
Considering the facts and circumstances of the case, let above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned I/C Chief Judicial Magistrate, Sitamarhi, in connection with Sitamarhi P. S. Case No. 735 of 2017.
