JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 14-02-2022 Heard learned counsel for the petitioners and the State. Petitioners seek regular bail in a case registered for the offence punishable under sections 304B/34 of the Indian Penal Code.

As per the prosecution case, these petitioners and their family members killed informant's daughter due to nonfulfilment of demand of dowry. Learned counsel for the petitioners submits that the petitioners are brother-in-law and father-in-law respectively of the deceased and there is general and omnibus allegation of assault against all the accused persons and no specific overt act has been alleged against these petitioners. Husband of the victim is already in custody. Petitioners live separately and as such they have no concern with the affairs of the victim and her husband. They are in custody since 12.2.2021 and 26.12.2021 respectively. Investigation is complete.

Let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate VII, Bhagalpur in Sanokhar Amdanda Police Station Case No. 171 of 2020/GR No. 5036 of 2020.
