The petitioner seeks bail in a case registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code.
One truck dashed a motorcyclist and also an auto rickshaw in which eight persons were killed. The people of the vicinity agitated against the aforesaid accident and the mob set ablaze Buxar Industrial police station in which one Chowkidar Madan Yadav is said to have died due to burn injuries. It is submitted that the petitioner is not named in the FIR. No specific allegation is made against the petitioner. Further submission is that three cases Buxar (T) P.S. Case No. 117 of 2015, Buxar (T) P.S. Case No. 118 of 2015 and Buxar (I) P.S.
Patna High Court Cr.Misc. No.28602 of 2015 (2) dt.06-08-2015 2/2 Case No. 32 of 2015 were registered for the same occurrence. Similarly situated co-accused Manoj Rai, Sonu @ Md. Suiab Khan @ Suiab Khan, Khalik Khan @ Khalik Sah, Vikash Kumar Singh @ Vikash Singh, Santosh Bharti @ Santosh Kumar Bharti @ Sanosh Kumar Ram and Devendra Rai @ Tannu Rai have already been enlarged on anticipatory bail. The case of the petitioner stands on the same footing.
Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar in Buxar (I) P.S. Case No. 32 of 2015.
