The petitioner apprehends his arrest in Digha P.S. Case No.221 of 2017 registered under Sections 420, 467, 468, 379, 471, 120B, 34 IPC and 4, 40, 49 of Bihar Miner Mineral Concession Rule, 1972 and 3 of Bihar Mineral Prevention of Illegal Mining, Transported and Storage Rule, 2003.

The learned counsel for the petitioner submits that the police raided and arrested Manish kumar, Sudhir Kumar Singh and Mohan Sah and found that they had stored sands. Police again made raid in Polsan road, Digha and arrested different persons. One Tata Hyba vehicle bearing registration No.JH-11K-0561 was also seized.

The learned counsel for the petitioner further submits that

Patna High Court Cr.Misc. No.63521 of 2017 (2) dt.11-01-2018 2/2 the petitioner is the owner of Tata Hyba vehicle. Vehicle was parked by the side of the road and no sand was loaded on the aforesaid vehicle.

Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from the date of receipt / production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Patna in connection with Digha P.S. Case No.221 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
