The petitioner is languishing in custody since 26.11.2015 in connection with Tandwa P.S. Case No. 43 of 2015 for the offences instituted under Sections 304(B) and 201/34 of the IPC. The accusation is of killing the daughter and her son of the informant by accused persons for non-fulfilment of dowry demand.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The petitioner is in custody since 26.11.2015 and the charge sheet has been submitted in the present case. From perusal of the postmortem report, it is evident that there is no external or enternal injury on the body of

Patna High Court Cr.Misc. No.20202 of 2016 (3) dt.18-07-2016 2/2 the deceased. The petitioner made all efforts to search the deceased and he had informed the informant also regarding missing of the deceased.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R. and the dead body of the deceased is said to have been recovered from a Well which is closed to the house of the petitioner.

Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner. The same is rejected in Tandwa P.S. Case No. 43/2015, pending in the court of the learned J.M. Ist Class, Aurangabad. Anyhow, the trial court is directed to take all necessary steps to conclude the trial preferably within a period of one year from the date of receipt/production of copy of this order.
