JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-08-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report and it appears that name of petitioner came in confessional statements of co-accused persons. No doubt, in course of investigation, some witnesses stated about the involvement of the petitioner in the alleged crime but admittedly, the aforesaid witnesses are not an eye witness of the alleged occurrence. Petitioner carries criminal antecedent but in the present case, the investigating officer failed to collect any cogent evidence against the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on

Patna High Court Cr.Misc. No.27245 of 2015 (2) dt.03-08-2015 2/2 bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Madhepura in connection with Madhepura P.S. Case No. 53 of 2014.
