This is an application for grant of anticipatory bail in connection with Sono (Charkapather) P.S. Case No. 211 of 2016 registered for the offence punishable under Sections 304(B), 201/34 of the Indian Penal Code.
The allegation is regarding the accused persons killing the victim lady for demand of motorcycle.
The learned counsel for the petitioners submits that the petitioners no. 1 and 2 are the mother-in-law and father-in-law of the victim girl and they have no complicity in the matter since they are separate from the husband of the victim girl by metes and bounds. It is further submitted that the crux of
Patna High Court Cr.Misc. No.242 of 2018(3) dt.09-02-2018 2/2 allegation is against the husband of the victim girl, who is already in custody. In such view of the matter, it is prayed that at least the aged mother-in-law and father-in-law be released on anticipatory bail.
Having regard to the facts and circumstances of the case, I deem it fit and proper to admit the petitioners herein to the privilege of anticipatory bail, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1st, Jamui in connection with Sono (Charkapather) P.S. Case No. 211 of 2016 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
