JUSTICE SHIVAJI PANDEY ORAL ORDER 03-05-2016 Heard learned counsel for the petitioner and learned counsel for the State.

In this case, the petitioner is seeking bail in connection with Tekari P.S. Case No. 20 of 2015 registered for offences under sections 307/379 of the Indian Penal Code and Section 27 of the Arms Act.

In the First Information Report, it has been alleged that the Informant along with other four persons was going to solemnize his marriage in a temple and, in the way, they were intercepted by unknown persons. On the threat of life, the accused persons snatched the mobile. In course of investigation, it was found that one of the accused Kush Kumar was using the mobile. The name of the petitioner was surfaced on the confessional

Patna High Court Cr.Misc. No.18313 of 2016 (2) dt.03-05-2016 statement of Kush Kumar and Kush Kumar has been granted bail by this Court by order dated 2.11.2015 in Cr. Misc. No. 30831 of 2015. Sidheshwar Manjhi @ Sidheshwar Manjhi has also been granted bail by order dated 2.11.2015 in Cr. Misc. No. 44024 of 2015.

Looking to the facts and circumstances of the case, let the petitioner, namely, Ramashish Manjhi, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 9th, Gaya in connection with Tekari P.S. Case No. 20 of 2015, subject to the condition that (i) one of the bailors shall be a close relative of the petitioner (ii) if the petitioner is found involved in future in similar type of case, the prosecution will be at liberty to make prayer for cancellation of his bail and the court below will pass necessary order, including cancellation of bail and (iii) the petitioner would cooperate the proceeding of the court below. In event of failure to appear on two consecutive dates, the court below will be at liberty to pass the order, including cancellation of bail bonds.
