The petitioner seeks bail in a case instituted for the offence under Section-30(a) of Bihar Prohibition and Excise Act, 2016. Prosecution case, in short, is that 3.75 litres wine is recovered.
It has been submitted on behalf of the petitioner that petitioner is in custody since 31-01-2018. There is no allegation of tampering of witnesses against the petitioner. It is alleged that 3.75 litres wine is recovered from an open land. There is no compliance of Section-100 Cr.P.C.
On behalf of the State, it is submitted that petitioner is not named in the F.I.R./complaint case.
Considering the aforesaid facts and circumstances,
Patna High Court Cr.Misc. No.14690 of 2018 (2) dt.15-03-2018 it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional District & Sessions Judge, Banka in connection with Amarur P.S. Case No. 425 of 2017.
