Heard learned counsel for the petitioner, learned counsel for the informant as well as learned Additional Public Prosecutor for the State.
Petitioner is named in the first information report but omnibus allegation of assault has been levelled against him and it is alleged that he along with others assaulted the deceased with fists and slaps. Furthermore, it is obvious from the first information report that it was co-accused, Triveni Singh who assaulted the deceased with danda. Moreover, the post mortem report of the deceased reveals that no any external injury was found on his person and the doctor could not ascertain the definite
Patna High Court Cr.Misc. No.31030 of 2015 (3) dt.18-08-2015 2/2 cause of death of the deceased.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Vaishali P.S. Case No. 42 of 2015.
