JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-07-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. In the impugned order, learned 3rd Additional Sessions Judge, Siwan referred paragraphs no. 17, 18, 19 and 20 of the case diary to show the involvement of the petitioner in the alleged crime and it has been mentioned by the learned Additional Sessions Judge that in the aforesaid paragraphs witnesses disclosed about the involvement of the petitioner in the alleged crime but learned counsel appearing for the petitioner drew my attention towards paragraphs no. 9 and 10 of the petition and submits that in the aforesaid paragraphs the witnesses have claimed only to this extent that they had seen the petitioner roaming near the place of occurrence on the alleged date of
Patna High Court Cr.Misc. No.26310 of 2015 (2) dt.27-07-2015 occurrence.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Siwan in connection with Hussainganj P.S. Case No. 209 of 2014.
