JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-b)a, 26 of the Arms Act. One country made pistol and one live cartridge are said to have been recovered beneath the driver's seat of an Auto which was being driven by the petitioner at the time of alleged recovery.

Submission on behalf of the petitioner is that the present case has been planted by the police at the behest of enemies of the petitioner. Moreover, petitioner is in jail custody since 15.03.2016 and except the present case as well as two cases

Patna High Court Cr.Misc. No.19908 of 2016 (2) dt.06-05-2016 2/2 i.e. Alauli P.S. Case No. 42 of 2015 and Alauli P.S. Case No. 185 of 2015, petitioner does not have any other criminal antecedent. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Khagaria in connection with Alauli P.S. Case No. 60 of 2016.
