JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report but one Anil Sah was arrested in Majorganj P.S.Case No. 20 of 2015 in which the aforesaid Anil Sah made his confessional statement disclosing his involvement as well as involvement of the petitioner in the present crime. The petitioner surrendered before the court below in connection with Majorganj P.S.Case No. 20 of 2015 and, after that, he was remanded in the present case. Furthermore, it would appear from perusal of the impugned order that in course of investigation, two prosecution witnesses vide paragraphs 51 and 52 of the case diary claimed to have seen the petitioner near the place of occurrence. It appears that except the

Patna High Court Cr.Misc. No.20091 of 2016 (2) dt.09-05-2016 2/2 aforesaid material and some criminal antecedent of the petitioner, there is nothing against the petitioner. Petitioner is in jail custody since 20.02.2016 and the investigation against the petitioner has already been completed.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in connection with Majorganj P.S.Case No. 11 of 2016.
