The petitioner seeks pre-arrest bail in connection with Forest Case No. 69/2018 registered under Sections 33 (c) 41, 42 Forest Act.

The accusation is that on getting information of running of an illegal Saw Mill, the informant, being the Forest Guard, Maharajganj and the Circle Officer, Kutumba, raided in village Polla and on seeing the patrolling party, the owner and labourers of the Saw Mill started fleeing away and on chase they succeeded to flee away. Thereafter, Saw Mill was seized and seizure-list was also pasted in front of the Saw Mill.

Patna High Court CR. MISC. No.49576 of 2019(6) dt.20-11-2019 2/2 Submission is that, in fact, seized Saw Mill is one of Vishwanath Sharma, resident of Mohalla Pipardih (Deo Road), Aurangabad, where the petitioner used to do the work of labourer but he has falsely been implicated in this case. The petitioner has got no criminal antecedent.

Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Forest Case No. 69/18 shall be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Court of C.J.M., Aurangabad or the successor Court, subject to the conditions as laid down under Section 438 (2) of the Criminal Procedure Code.
