JUSTICE SUDHIR SINGH ORAL ORDER 29-01-2022 Due to the third wave of COVID-19 Pandemic, the matter is being taken up by way of virtual Court proceeding. The matter has been listed under the heading "For Orders" under the orders of Hon'ble the Chief Justice. Heard learned counsel for the petitioner and the State through virtual mode.
On behalf of the State, it has been submitted that from perusal of paragraphs-91, 97, 102, 103 & 13 of the case diary, it appears that the process under Sections-82 & 83 of the Cr.P.C. has already been issued against the petitioner and in the light of the same, the present anticipatory bail application is not maintainable.
Considering the aforesaid submission, the present application filed in connection with Desari P.S. Case No. 151 of
Patna High Court CR. MISC. No.4600 of 2021(3) dt.29-01-2022 2/2 2020 is dismissed as not maintainable.
If the petitioner surrenders in the court below and seeks regular bail, the same shall be considered on its own merit without being prejudiced by this order.
