It would appear from perusal of the report of learned Additional Sessions Judge,-III, Bhagalpur that trial of the petitioner has already commenced and uptill now, four prosecution witnesses have already been examined. However, it is informed on behalf of petitioner that altogether five prosecution witnesses have been examined in this case.
Therefore, considering the aforesaid facts and circumstances as well as submission of the parties, I am not inclined to release the petitioner on bail and accordingly, his prayer for bail in connection with Kahalgaon (Ghogha) P.S. Case No. 188 of 2002 corresponding to Sessions Trial No. 864 of 2014 is, again, rejected on the grounds, mentioned by me in my
Patna High Court Cr.Misc. No.23384 of 2016 (3) dt.21-09-2016 2/2 previous order dated 23-04-2015 passed in Cr. Misc. No. 4391 of 2015.
However, learned trial court is directed to expedite the trial of the petitioner and try to conclude the same as early as possible, preferably, within six months from the date of receipt/production of copy of this order, failing which, the petitioner may renew his prayer for bail before the learned trial court itself.
