Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks regular bail in connection with Darbhanga Sadar P.S. Case No.171 of 2021 dated 19.04.2021 registered for the offence/s punishable under Section/s 341, 324, 307/34 of the Indian Penal Code and later on Section 302 of the IPC was added.

The main submissions advanced by the learned counsel for the petitioner are that the petitioner has no criminal antecedent and has been languishing in jail since 17.05.2023 and as per the allegations levelled in the FIR the petitioner and co-accused persons namely Dineshwar Lal Deo, Manoj Lal Deo and Anjila Devi are stated to be order givers who instigated the other co-accused persons to kill the victim, except this there is no any allegation

Patna High Court CR. MISC. No.49050 of 2023(2) dt.04-08-2023 2/2 against this petitioner and the co-accused persons namely Vikash Lal Deo, Dineshwar Lal Deo @ Jhimi Lal Deo, Anjila Devi, Amarnath Lal, Chote Lal Deo and Anil Lal Deo have been granted bail by different Benches of this Court vide orders passed in Cr. Misc. Nos.45741 of 2021, 21984 of 2022, 70161 of 2021, 3287 of 2022 and 36955 of 2022 respectively. Further submissions are that the main allegation of inflicting knife blows at the victim is against co-accused persons and not against this petitioner and altogether 11 accused persons including this petitioner have been named in the FIR and against him the investigation has been completed. 4.

Learned APP appearing for the State opposes the bail prayer.

Considering the above submissions and mainly the privilege of bail having been granted to several co-accused persons mentioned-above, the nature of allegation appearing against this petitioner and the completion of investigation against him, in my opinion it is a fit case for bail to the petitioner. Accordingly, let the petitioner named-above be released on bail in connection with Darbhanga Sadar P.S. Case No.171 of 2021 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned. (Shailendra Singh, J) sangam/- U T
