JUSTICE SUDHIR SINGH ORAL ORDER 27-07-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner seeks regular bail in a case registered for the offences punishable under sections 304-B, 201/34 of the Indian Penal Code.
One Ravindra Jha filed a complaint case alleging therein that his daughter Pinki Devi was married with Sujit Mishra @ Pandit in the year 2006 and he gifted many articles at the time of marriage. When the complainant visited the house of his daughter in January, 2010, his daughter was not found inside the house and the accused persons fled away. It is alleged that for non fulfillment of dowry demand, the accused persons have killed her daughter and the dead body has been caused to disappear.
Patna High Court Cr.Misc. No.26735 of 2015 (2) dt.27-07-2015 On behalf of the petitioner it is submitted that the petitioner is in custody since 06.04.2015. Charge-sheet has been submitted in the case. The petitioner has no criminal antecedent. Petitioner is the father-in-law of the deceased. It is further submitted that other co-accused persons have been granted anticipatory bail vide Criminal Misc. No. 26623 of 2015. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the facts aforesaid, let the petitioner above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Tisiauta P.S. Case no. 28 of 2010.
