====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 25-06-2021 Heard the parties in virtual Court proceeding. The petitioner is languishing in custody for the offences punishable under Sections 25(1-A), 25(1-AA), 25(1-B) (a), 25(1-AC), 26(1)(2) and 35 of the Arms Act, 1959. Co-accused Md. Injammamul Haq has already been allowed bail by a co-ordinate Bench of this court. Petitioner is in custody since more than one and half year and his case is identical to co-accused Md. Injammamul Haq.
The report of the court below would reveal that even the police papers have not been supplied to the accused under Section 207 Cr.P.C.
Considering the entire facts and no material to substantiate that the petitioner is going to tamper with the
Patna High Court CR. MISC. No.3389 of 2021(4) dt.25-06-2021 2/2 evidence, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with N.H. Bangra P.S. Case No. 08 of 2020, with following conditions:
(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (c) The petitioner shall not leave the country without permission of the trial Court.
