JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 29-06-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Roh P.S. Case No. 28 of 2015 registered under Section 120B of the Indian Penal Code.

Learned counsel for the petitioner submits that, in fact, the petitioner was apprehended by the police showing recovery of arms in Roh P.S. Case No. 26 of 2015 and thereafter his confessional statement was recorded on 22.03.2015 as detailed in the F.I.R. of present case, showing conspiracy with Navin Singh who was in jail custody for committing other offence except that no material has been collected against the petitioner. It is further submitted that petitioner is in custody since 01.05.2015.

No.19426 of 2016 (3) dt.29-06-2016 Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the J.M. Ist Class, Nawada, in connection with Roh P.S. Case no. 28 of 2015. Out of two sureties, one surety must be the close relative of the petitioner.
