The petitioner is languishing in custody for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.
The petitioner or any other person was not there at the time of recovery of liquor; rather the villagers who assembled at the time of seizure disclosed to the police that the liquor was of the petitioner and others.
The petitioner has stated on oath that he has got no criminal antecedent. The petitioner is in custody since 16.10.2020. Investigation of the case is already complete. Considering the facts aforesaid, let the petitioner,
Patna High Court CR. MISC. No.3255 of 2021(2) dt.05-04-2021 2/2 above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Parwalpur P.S. Case No.174 of 2020, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
