JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 04.01.2016 on the accusation that he having entered into the house of the informant made attempt to outrage the modesty of victim, who happens to be minor girl, but submission on behalf of the petitioner is that there was some dispute between the parties and, as a matter of fact, the informant having set up his grand daughter lodged this false case against the petitioner and also got recorded her statement under section 164 Cr.P.C. It is further submitted that the victim in her statement recorded under section 164 of the Cr.P.C has only stated that petitioner tried to catch her and also put his hand on her mouth and except the aforesaid act, the petitioner did nothing.
