Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code, Section 17 of the Criminal Law Amendment Act and Section 27 of the Arms Act.
The petitioner is not named in the FIR relating to occurrence of murder. Name of the petitioner transpired in the confessional statement of co-accused Mukesh Patel @ Vishal Ji and thereafter the petitioner was apprehended and he also confessed before the police.
Considering the fact that confession before the police is no material for refusal of bail, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/-
Patna High Court Cr.Misc. No.14772 of 2018 (2) dt.14-03-2018 2/2 (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Baikunthpur Police Station Case No. 173 of 2015, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
