JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 09-10-2015 Heard learned counsel for the petitioner no. 1 and learned APP for the State.

The petitioner no. 1 seeks bail in connection with Majorganj P.S. Case No. 14 of 2015 registered for the offence punishable under Sections 25(1-B)A, 26/35 of the Arms Act. Allegedly, the petitioner no. 1 and others made indiscriminate firing causing death of a person for which Majorganj P.S. Case No. 13 of 2015 was registered. During search one country made gun was recovered from the room of the petitioner no. 1.

Submission is that the petitioner is in custody since 13.03.2015 and he has been enlarged on bail in Majorganj P.S.

Patna High Court Cr.Misc. No.26389 of 2015 (4) dt.09-10-2015 Case No. 13 of 2015 vide order dated 23.07.2015 passed in Cr. Misc. No. 25694 of 2014.

In the facts and circumstances stated above and considering the period of detention, the petitioner no. 1 above named is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Majorganj P.S. Case No. 14 of 2015, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
