JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section395 of the Indian Penal Code. It is a serious case of dacoity but from perusal of impugned order, I find that in course of investigation, name of the petitioner surfaced in this case in confessional statement of coaccused, who stated that the petitioner was main conspirator of the alleged occurrence. Moreover, it would also appear from the impugned order that at the time of alleged occurrence, the petitioner was in jail custody.

No doubt, petitioner carries criminal antecedent but in the present case, except confessional statement of co-accused as

Accordingly, petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Rajepur P.S. Case No. 16 of 2014 to the satisfaction of learned Sub Divisional Judicial Magistrate, Sadar, Motihari, East Champaran.
