JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 17-03-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 302, 201, of the Indian Penal Code.
The petitioner is alleged to have committed the murder of his wife with the help of other accused persons.
It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. The marriage of the petitioner was solemnized with the victim about 12 years
Patna High Court CR. MISC. No.48984 of 2022(4) dt.17-03-2023 2/2 ago. The petitioner was not apprehended from the spot. The dead body of the victim was found kept in a trolly bag in and abandoned condition. The name of the petitioner has transpired in this case only on his self confession which has no evidentiary value in the eye of law. No consistent material has come against the petitioner during investigation. There is also no eye witness occurrence. The petitioner is languishing in custody since 20.05.2022.
Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IX, Jahanabad in connection with Banshi P.S. Case No. 34 of 2022.
