JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 18-05-2016 The petitioner wants to renew his prayer of bail in connection with Sessions Trial No. 121 of 2015 arising out of Lakhisarai P. S. Case No. 77 of 2005 pending in the Court of learned Adhoc A.D.J, Vth, Lakhisarai which was earlier rejected by order dated 21.03.2016 passed in Criminal Misc. No. 29848 of 2015 on the ground that in this case charge has already been framed on 10.09.2015 itself and the trial is not likely to be concluded in near future and as such, the petitioner deserves sympathetic consideration.

The learned APP submits that the petitioner is named in the first information report, it is a case of double murder and the petitioner remained absconding since long. In the facts and circumstances stated above,

Patna High Court Cr.Misc. No.21191 of 2016 (2) dt.18-05-2016 2/2 considering the allegation attributed against the petitioner, at present, I am not inclined to enlarge the petitioner on bail and accordingly his such prayer stands rejected.

However, the trial court is directed to expedite the trial and conclude the same preferably within six months after taking the same on priority basis from the receipt or production of a copy of this order failing which the petitioner, if at no fault, may be at liberty to renew his prayer for bail.
