Petitioners, already in custody, seek bail in connection with Manpur P.S. Case No.150 of 2017, registered under Sections 399, 402 of the Indian Penal Code as well as under Sections 25(1-b)a, 26 of the Arms Act.
Allegation in brief is that one country made pistol with three live cartridges from each of these two petitioners were recovered.
Learned counsel for the petitioner contends that the petitioners were employees of the company engaged in sand mining, petitioner no.1 has clean antecedent and petitioner no.2
Patna High Court Cr.Misc. No.18564 of 2018(2) dt.02-04-2018 2/2 has two criminal antecedents and in these two cases, petitioner no.2 is on bail and both the petitioners are in custody since 22.10.2017.
Having considered the said facts and circumstances, petitioners, namely, Bahadur Paswan and Surendra Prasad Yadav @ Surendra Yadav @ Tetar Yadav are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM-VIIth, Nalanda at Biharsharif in connection with Manpur P.S. Case No.150 of 2017 with a condition that the petitioners shall remain physically present on each and every date before the trial court and if they absent themselves on two consecutive dates without any reasonable cause, their bail bonds shall liable to be cancelled.
