For the Opposite Party/s :

Mr. Amitesh Kumar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJESH KUMAR VERMA ORAL ORDER 02-03-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Learned counsel for the petitioner is permitted to remove the defect(s), as pointed out by the office, if any, within a period of four weeks from today.

Petitioner seeks bail in a case registered for the offences punishable under Sections 304B and 34 of the Indian Penal Code.

According to prosecution case, the allegation against the petitioner is that about four years ago, he married with the sister of the informant and after that he started demanding dowry and due to non-fulfillment of the demand of dowry he committed murder of the deceased by pouring kerosene oil. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.50925 of 2022(4) dt.02-03-2023 2/2 petitioner has clean antecedent and he has falsely been implicated in the present case. He further submits that the petitioner is husband of the deceased and the allegation against the petitioner in the F.I.R. is false and fabricated. The learned Additional Public Prosecutor for the State on the other hand has vehemently opposed the prayer for bail of the petitioner and submits that there is direct allegation against the petitioner that he burnt the deceased by pouring kerosene oil on her body.

Considering the aforesaid facts, I am not inclined to enlarge the petitioner on bail in connection with Sukhani P.S. Case No. 18 of 2022, pending in the court of learned Chief Judicial Magistrate, Kishanganj.

Prayer is refused.
