JUSTICE SANJAY PRIYA ORAL ORDER 2/ 17-01-2018 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner apprehends his arrest in Raniganj P.S. Case No.203 of 2017 instituted for the offence under Section(s) 366, 364, 120-B Indian Penal Code pending in the Court of the Chief Judicial Magistrate, Araria.

Prayer of the petitioner for grant of anticipatory bail was earlier rejected by this Court by order dated 06.09.2017 passed in Cr. Misc. No.37361 of 2017.

Counsel for the petitioner has submitted that this petitioner is living with the alleged victim. Both are major. Victim is also carrying pregnancy.

From the earlier order, this Court finds that the petitioner was directed to surrender in the Court below and seek

Patna High Court Cr.Misc. No.197 of 2018 (2) dt.17-01-2018 2/2 regular bail, which shall be considered in accordance with law by the Court below.

Therefore, this Court is not inclined to review its earlier order.

However, petitioner is directed to surrender in the Court below with the aforesaid submission and the Court below will dispose of the regular bail of the petitioner without being prejudiced by this order preferably on the same day.
