The petitioner seeks bail in Nadi P.S. Case No. 45 of 2017 registered under Sections 25(1-b)a, 26 and 35 of the Arms Act.

Petitioner is said to have been apprehended with a single barrel gun and two live cartridges on chase given by the police.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in this case at the instance of his enemies by planting aforesaid recovery from his possession. No incriminating article has been recovered from his

Patna High Court Cr.Misc. No.15370 of 2018 (2) dt.19-03-2018 2/2 conscious physical possession. Though two more criminal cases have been lodged against the petitioner, but they are under bailable sections and the petitioner is on bail in the said cases. The petitioner has been languishing in custody since 21.08.2017. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-II, Bagaha, West Champaran in connection with Nadi P.S.
