JUSTICE ANIL KUMAR SINHA ORAL ORDER 23-12-2022 Heard Mr. Rajeev Ranjan, learned counsel for the petitioner and Mr. Lalan Kumar, learned Additional Public Prosecutor appearing for the State through video conferencing. Petitioner seeks regular bail in connection with Ujiarpur P.S. Case No. 08 of 2016 registered for the offences punishable under Sections 341, 386, 307/34 of the Indian Penal Code 1860 and Section 3/4 of the Explosive Substance Act. As per the prosecution case, the informant was running a CSP of SBI Bank and while he was sitting at the tea stall, the petitioner along with other co-accused persons arrived there, started abusing the informant and co-accused Dhananjay Ishwar, on the gun point, put AK-47 rifle on the chest of the informant and, thereafter, the petitioner demanded a sum of Rs.5,00,000/- as extortion money to be paid by the
Patna High Court CR. MISC. No.49315 of 2022(2) dt.23-12-2022 2/3 informant within one week. While fleeing, the accused persons also hurled bomb upon the informant, but the same did not explode.
Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case with oblique motive. He next submits that the petitioner was not arrested on the spot and he has surrendered on 14.2.2022 inasmuch as the petitioner was not knowing about lodging of the present case against him. He was out of village for earning his livelihood. Learned counsel further submits that the petitioner has got no criminal antecedent and he is in custody since 14.2.2022. The other co-accused persons namely, Golden Kumar and Dhananjay Ishwar @ Dhananjay Kumar @ Dhananjay Kumar Ishwar have been granted bail by co-ordinate Benches of this Court in Cr. Misc. 55187 of 2017 and 13724 of 2019 respectively.
Regards being had to the submission made by the parties and taking into consideration the fact that the petitioner is in custody since 14.2.2022 having no criminal antecedent and other similarly situated co-accused persons have been granted bail by co-ordinate Benches of this Court, I am inclined to grant regular bail to the petitioner.

No.49315 of 2022(2) dt.23-12-2022 3/3 Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.20,000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. Dalsinghsarai, Samastipur in connection with Ujiarpur P.S. Case No. 08 of 2016 subject to the condition that the petitioner will be well represented on each date in the trial and if he fails to do so on two consecutive dates, his bail bonds will be liable to be cancelled.
