JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 16-10-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor and perused the case diary. The petitioner is in custody in connection with Karakat P.S.Case No.55 of 2019 registered for an offence under Sections 307, 341, 323 and 504/34 of the Indian Penal Code. As per prosecution case, the informant and his friend while getting back after seeing match and when they arrived near the house of one Ajay Singh, petitioner started abusing him and when he prevented, he called his brother Arun Singh who also provoked his brother Ajay Singh. Then Ajay Singh went into his home and brought a revolver and fired upon the chest of the informant.
It is submitted on behalf of the petitioner that the
Patna High Court CR. MISC. No.46107 of 2019(4) dt.16-10-2019 2/2 petitioner has falsely been implicated in this case merely on suspicion. There is case and counter case between the parties. Both sides received injuries. It is also submitted that the injury report does not support the prosecution story. It is further submitted that petitioner is in custody since 09.05.2019. In view of the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Bikramganj (Rohtas) in connection with Karakat P.S.Case No.
55 of 2019 with following conditions:- (i) Petitioner shall cooperate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the Court and his absence on two consecutive dates without sufficient reason, his bail bond shall be cancelled by the court below. (ii) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
