The petitioner apprehends his arrest in Kudra P.S. Case No.216 of 2017 registered under Sections 414, 34 of the Indian Penal Code and Section 11(1)(a)(d)(e)(f) of the Prevention of Cruelty to Animals Act.

The police intercepted a pick-up van loaded with animals. The driver and his accomplish tried to flee away but arrested by the police.

The learned counsel for the petitioner submits that petitioner is the owner of the vehicle. The driver of the vehicle was plying the van on hire. The co-accused Ishtiyak Kuraishi has purchased the animals and he had taken the vehicle on hire and the purchased animals were transported.

Patna High Court Cr.Misc. No.398 of 2018 (2) dt.16-01-2018 Considering the facts aforesaid and the fact that the petitioner is the owner of the vehicle, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Shailendra Kumar, J.M. Ist Class, Bhabhua, District Kaimur in connection with Kudra P.S. Case No.216 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
