JUSTICE SUDHIR SINGH ORAL ORDER 08-06-2015 The petitioner is languishing in custody since 20.07.2014 in connection with Madanpur P.S. Case No. 136 of 2014 for the offences instituted under Sections 147, 148, 149, 341, 328, 337, 353, 307, and 124 a of the Indian Penal Code, Section 27 of the Arms Act, Section 3/4 of the Explosive Substances Act and Section 17 of the C.L.A. Act.
Heard learned counsel for the petitioner and learned counsel for the State.
The prosecution story, in brief, is that on 19.07.2014 when about 500 people were brick batting and were trying to break the gate of Madanpur Police Station, one police jeep was put on fire by the mob. It is further said that they were damaging the furniture of the office of the Circle Police Inspector and the records were put on fire. They were also firing on the police and
Patna High Court Cr.Misc. No.15706 of 2015 (2) dt.08-06-2015 2/2 have put the dead body on the road and they blocked the road. Thereafter District Magistrate and the superintendent of Police have tried to persuade them but they did not obey and they were brick batting and made fire on them causing injuries to the police personnel.
It has been submitted on behalf of the petitioner that altogether 16 persons have been named in the first information report and there is no specific allegations against the petitioner and general and omnibus allegations have been made against him. Further it has been submitted that the petitioner is in custody since 20.07.2014. It has been pointed out other co-accused in the present case has been granted bail vide Annexure-2.
It has been submitted on behalf of the State that the petitioner is named in the first information report. Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Madanpur P.S. Case No. 136 of 2014.
