The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 272, 273 of the Indian Penal Code and Sections 30(a), 38(B) of the Bihar Excise Prohibition Act, 2018.

It is alleged that there is recovery of total 2.340 liters of foreign liquor from accused persons including the petitioner. It has been submitted by learned counsel for the petitioner that the petitioner is innocent and has falsely been implicated in this case. There is no recovery from the conscious possession of the petitioner. On the basis of confessional statement of co-accused, namely, Sudama Prasad, petitioner has been made accused in this case. In the aforesaid facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-IInd cum Special Judge, Excise, Siwan, in connection with Siswan P.S.
